TERMS & CONDITIONS

•No purchase necessary.

•Contest eligibility is open to all continental United States residents, 18 years of age or older, currently enrolled in study at an accredited college or university in the continental United States, which excludes Hawaii, Alaska, the US Virgin Islands and Puerto Rico.

•Contest begins on September 15, 2017 and will run through ​​​​December 15, 2017. All sales occurring during that time will qualify eligible participants for entry into prize drawings.

•Fundraiser and associated contest is run by LQL G.E.M.S 752 N. Main Street, Unit 62, Mansfield, TX 76063.

•Number of prizes, the accurate description of each prize, the retail value of each prize and the odds of winning each type of prize are detailed below.

•Non-cash prizes are not redeemable for cash. LQL G.E.M.S. reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value.

•Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner.

•RELEASE - By entering, all participants release and hold harmless the promotion sponsors, LQL G.E.M.S, and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign a form releasing LQL G.E.M.S and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.

•LICENSE - Entry into any contest constitutes full permission for LQL G.E.M.S. and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

•TAXES - If required by applicable law, LQL G.E.M.S. will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099. Winners must provide their social security number to LQL G.E.M.S. for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.

•PARTICIPANT ELIGIBITY – Submission of a completed registration, participants confirm that they meet all of the outlined requirements. All participants must be legal US residents age 18 or over. Participants must be actively enrolled, in good standing at an accredited college or university in the continental United States of America. Participants agree to promote the sale of the product(s) detailed in the current fundraiser using the guidelines set forth in the program details, which is sent following registration confirmation. Proof of eligibility is required prior to the start of the program. Proof of active student status includes a current roster or verification letter from the college/university registrar’s office. Enrollment is subject to verification by LQL G.E.M.S. representatives.

•GENERAL - Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won. LQL G.E.M.S reserves the right to rule ineligible participants who, in LQL G.E.M.S’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by LQL G.E.M.S or its affiliates. LQL G.E.M.S reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of LQL G.E.M.S and whose decisions with respect to all aspects of the contest are final and binding. Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the LQL G.E.M.S 752 N. Main Street, Unit 62, Mansfield, TX 76063 for 60 days after the contest concludes.

•Monthly prize winners will be announced 15 business days following the end of the prior contest month. For the purposes of this contest, a month begins and ends on the 15th of each contest month. 

PRIZE RULES – Specific to the Lance Gross & Colin Kaepernick Fundraiser

•All eligible participants must meet or exceed $1000.00 USD in individual sales, during each eligible month of participation in the above-named fundraiser to be eligible for prize drawings. Odds of winning monthly drawings are dependent upon the number of eligible entrants. Exceptions include the monthly flash challenges whereby additional qualifications will be identified when the contest is announced.

•The frequency of awarded prizes can be increased or decreased at the sole discretion of LQL G.E.M.S.

SPECIFIC PRIZE TERMS & ELIGIBILITY

•MONTHLY SURPRISE DRAWING - This prize is awarded to a minimum of one (1) to maximum of twenty-five (25) randomly selected participant(s) of the specified LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for the prize drawing. ERV is determined at the time of contest announcement with a minimum ERV of 25.00 USD. Winners will be selected randomly, once per fundraiser period month on or about fifteen (15) business days after the end of the fundraiser month from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. Prize will be awarded under the condition that all eligibility rules have been met.

•200 CASH – This prize is awarded only to five (5) randomly selected participant(s) of the specified LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for the prize drawing. ERV is capped at 200.00 USD delivered via a VISA Gift Card. Five (5) winners will be selected randomly, once per fundraiser period month on or about fifteen (15) business days after the end of the fundraiser month from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. Prize will be awarded under the condition that all eligibility rules have been met.

•PAY MY BILLS – This prize is awarded only to five (5) randomly selected participant(s) of the specified LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for the prize drawing. ERV is capped at  USD. Written proof of up to three (3) bills to be paid must be submitted to LQL G.E.M.S. to review and authorize payment(s) to the debtor(s), not to exceed a total of 250.00 USD. Billing statement(s) must be in the name of the winning participant. Participants may only win this prize once within a specific campaign fundraiser period. Five (5) winners will be selected randomly, once per fundraiser period month on or about fifteen (15) business days after the end of the fundraiser month from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. Prize will be awarded under the condition that all eligibility rules have been met.

•1000 TUITION HELP - This prize is awarded to one  (1) randomly selected participant from each participating campus with a minimum of two eligible participating student fundraisers of the specified LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for the prize drawing. ERV is capped at 1000.00 USD. Participants may only win this prize once within a specific campaign fundraiser period. Number of winners determined by the number of eligible campuses. Drawing will occur once per fundraiser campaign on or about fifteen (15) business days after the end of the fundraiser campaign from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. Prize will be awarded under the condition that all eligibility rules have been met.

•CAMPUS AWARD - This one time donation is awarded only to the one (1) campus whose enrolled participants and  outside supporting sales  have produced the top combined sales total during the fundraiser campaign. This one time donation is valued at 5000.00 USD and is to be awarded no later than 90 days beyond the specified 2017 LQL G.E.M.S. fundraiser campaign end date. One (1) winner will be selected at the end of the contest period, from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. Prize will be awarded under the condition that all eligibility rules have been met.

•2018 SPRING BREAK IN MIAMI - This prize is awarded only to the third overall top selling participant(s) of the specified LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for the prize drawing. ERV is estimated between 2500.00 - 3500.00 USD. Includes air and hotel accommodations for four (4) attendees & 500.00 USD VISA gift card for discretionary spending. One (1) winner will be selected at the end of the contest period, from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. Prize will be awarded under the condition that all eligibility rules have been met.

•2018 NBA ALL STAR WEEKEND - This prize is awarded only to the second overall top selling participants of the specified LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for the prize drawing. ERV is estimated between 4000.00 - 6000.00 USD. Includes air and hotel accommodations for two (2) attendees, admission into 2018 All-Star Game and 2018 All-Star Celebrity Game. One (1) winner will be selected at the end of the contest period, from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Odds of winning depend on number of eligible entries received. LQL G.E.M.S. is not responsible for any changes of dates, times, venues or locations and or cancellations of events enacted by the NBA or any other sponsoring or otherwise affiliated third party. Prize will be awarded under the condition that all eligibility rules have been met.

•GRAND PRIZE 2017 FORD FUSION - this prize is awarded only to the overall top sales producer for all contest months in the specified 2017 LQL G.E.M.S. fundraiser(s). Participants must meet or exceed 1000.00 USD in product sales, in each contest month, in order to qualify for GRAND PRIZE drawing. One (1) vehicle will be awarded during each announced contest period. Odds of winning depend on number of eligible entries received. LQL G.E.M.S. maintains complete control and jurisdiction regarding the make, model, year and color of the prize vehicle. ERV is estimated between 21,000.00 – 26,000.00 USD determined by final model selection. One (1) winner will be selected at the end of the contest period, from all entries received during that contest period, and notified by phone or email. Winner selection is subject to confirmation of eligibility. Initially-selected winner(s) must confirm acceptance of prize within two (2) business days of initial winner notification. Failure to do so may result in disqualification and selection of a new winner. Contest winner responsible for filing appropriate federal & state taxes where applicable. Prize will be awarded under the condition that all eligibility rules have been met.

•DISCLAIMER - LQL G.E.M.S. undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). LQL G.E.M.S. is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes immediately upon receipt. LQL G.E.M.S. is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest. If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of LQL G.E.M.S. management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).
